The following are the terms and conditions for use of the Superquinn.ie Online Shopping Website or any Internet site to which the Website is linked (the "Website"). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Superquinn.ie Site. 

 

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
 
1. Use of the Superquinn.ie Site
You are entirely responsible for any and all activities that occur under your Account which is provided to you by BUY4NOW who host the transactional element of the website. You agree to notify us immediately of any unauthorised use or any other breach of security.

These Terms and Conditions govern your use of the Superquinn.ie Site and all services provided in connection with it. We reserve the right to change the terms of use or policies regarding the use of the Website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the terms of use on the Website.

You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through the Website.
 
2. Amendments
We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Superquinn.ie Site. The changes will apply to the use of the Superquinn.ie Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Superquinn.ie Site and the Online Shopping Site. If you continue to use the Superquinn.ie Site after the date on which the change comes into effect, your use of the Superquinn.ie Site indicates your agreement to be bound by the new Terms and Conditions.
 
3. Registration
To register with Superquinn.ie you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
 
4. Password and security
When you register to use the Superquinn.ie Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services (see below for contact details) immediately. If Superquinn.ie has reason to believe that there is likely to be a breach of security or misuse of the Superquinn.ie Site, we may require you to change your password or we may suspend your account.
 
5. Prices
Please note that the prices on our Grocery website are guide prices only. The actual price you pay will be the price charged in store at the time your order is picked for delivery. The actual order value cannot be determined until the day of delivery because the prices stated on the website may vary either above or below the prices in store on the day your order is picked and delivered. When your order is delivered you may return any item and receive a full refund if you consider that the difference between the price charged and the guide price shown on the Grocery website is unacceptable.

 

6. Delivery
At the time of delivery you will be required to validly sign-off on the delivery of the Products, after which time the Products become your sole responsibility. If a Product is defective in any way, we will arrange for collection of the Product from you at our cost and either deliver a new one to you or refund you the cost of the Product.
 
7. Rewards Card
You need to have a Superquinn Rewards Card to shop at the Superquinn.ie Site. Upon registration a Reward Card account will be created on your behalf and you will be issued with a physical card within 20 working days.
 
8. Excluded Services
The services provided by the Superquinn.ie Site do not include the provision of computer or other necessary equipment to access the Superquinn.ie Site. To use the Superquinn.ie site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur. 
 

9. Intellectual Property
You acknowledge that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to you by the Website or CD ROM, by us, or our advertisers or other content providers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Superquinn.ie Site without written permission from Superquinn.ie.  No licence is granted to you in these Terms and Conditions to use any trade mark of Superquinn.ie or its affiliated companies including, without limitation, the trade marks SUPERQUINN, SUPERQUINN.IE and SUPERQUINN REWARDS CARD. 
  
10. Limitations
You may not use the Superquinn.ie Site for any of the following purposes:

a. Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
b. Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
c. Gaining unauthorised access to other computer systems
d. Interfering with any other person's use or enjoyment of the Superquinn.ie Site
e. Breaching any laws concerning the use of public telecommunications networks
f. Interfering or disrupting networks or web sites connected to the Superquinn.ie Site
g. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
h. Superquinn.ie reserves the right to refuse to post material on the Superquinn.ie Site or to remove material already posted on the Superquinn.ie Site.
i. You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
 - Any claim by any third party that the use of the Superquinn.ie Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice.

 - Any claim by any third party that the use of the Superquinn.ie Site by you infringes that third party's copyright or other intellectual property rights of whatever nature; and any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Superquinn.ie Site by you.

 

11. Availability of the Superquinn.ie Site
Although Superquinn.ie aims to offer you the best service possible, Superquinn.ie makes no promise that the services at the Superquinn.ie Site will meet your requirements. Superquinn.ie cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the Customer Services (see below for contact details) or by email at help@Superquinn.ie and we will attempt to correct the fault as soon as we reasonably can. Your access to the Superquinn.ie Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Superquinn.ie will attempt to restore the service as soon as it reasonably can and will endeavor to notify you in advance of such restrictions

 

12. Superquinn.ie's Right To Suspend Or Cancel Your Registration
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions. You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the Superquinn.ie Site.
 
13. Superquinn.ie's Liability
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products. 
 
14. Third Party Websites
As a convenience to Superquinn.ie customers, the Superquinn.ie Site may include links to other web sites or material which are beyond its control. Superquinn.ie is not responsible for content on the Internet or pages on any other site outside the Superquinn.ie Site.
 
15. Advertising
We reserve the right at all times to place advertisements and promotions on the Website. Advertisers and sponsors on the Website are solely responsible for complying with all local, national, state and international laws (where relevant) and we exclude all liability howsoever caused there from. 
 
16. Applicable Law
The terms of use shall be governed by and construed fully in accordance with the laws of Ireland. You and we agree to submit to the exclusive jurisdiction of the courts located in Ireland. If any provision(s) of the terms of use is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

 

17. International Use
Superquinn.ie makes no promise that materials on the Superquinn.ie Site are appropriate or available for use in locations outside the republic of Ireland, and accessing the Superquinn.ie Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the Republic of Ireland, you do so on your own initiative and are responsible for compliance with local laws.

 

18. Disclaimer
The information contained in the Website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the Website is provided "as is" and "as available" and without warranties or conditions of any kind either express or implied. We accept no liability in relation to any of the above other than as may be provided for under your statutory rights.
 
19. General
We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident. Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. The section titles in the terms of use are solely used for the convenience of the parties and have no legal or contractual significance.

We would like to use your details from the application form, plus details on how you use your Reward Card and what you buy in our stores, to:

  • Help manage Superquinn Reward Card and improve the way we run it
  • Understand our customers' shopping habits to improve the service we offer
  • Unless you indicate otherwise, we will contact you with offers and information about products and services of interest to you and your family.

We will share your details among Superquinn Suppliers at home and abroad (e.g. Research Groups, of opt-in Research customers only), and businesses that process Reward Card information on our behalf (e.g. printers who need certain details to print your mailings & send you offers & promotions). In order to offer you the full benefits of the Reward Card we share limited information with The One4all® Gift Voucher Shop to enable customers to exchange their saved Reward Points for Gift Vouchers. To give you instant access to your current Reward Balance information and to enable you to instantly update your details your information is shared with Buy4Now who maintain www.superquinn.ie/rewards. Your information is always transferred in a secure manner and not sold onto 3rd parties.


We may also use and share information relating to groups of customers, without identifying individuals, to learn more about customer behavior and find ways of enhancing the service we offer you.
